Thensome, Inc. and/or its respective subsidiaries, parents, and affiliates (“Thensome”, “we”, “us”, “our”, or the “Company”) collect, use, and are responsible for certain Personal Information about you. We collect, use and are responsible for certain Personal Information about you. When we do this we are subject to various laws in the United States, including but not limited to the California Consumer Privacy Act of 2018 (“CCPA”) as well as other state and federal privacy laws and regulations.
By using our website, you acknowledge that you have read and understood this Privacy Policy and consent to the collection and use of your Personal Information as described herein.
1. Key Terms and Definitions.
Personal Information. Personal Information means information that identifies, relates to, describes, is capable of being associated with, or could be linked, directly, or indirectly, with a particular individual or household. Personal Information does not include publicly available information.
Processing. Any operation or set of operations which is performed on Personal Information or on sets of Personal Information.
Sensitive Personal Information. Personal Information revealing a consumer's driver's license or state identification numbers, credit card numbers, and precise geolocation.

- Internet or other electronic network activity information (e.g., browsing history, search history, and information regarding a consumer's interaction with an Internet web site, application, or advertisement);
- Geolocation data;
- Inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes; and
- Sensitive Personal Information.
6. Who We Share Your Personal Information With. We may routinely share Personal Information with:
- Our affiliates, including companies and brands owned or controlled by Thensome, if any;
- Service providers we use to help deliver our products and/or services to you, such as payment service providers, warehouses, and delivery companies;
- Other third parties we use to help us run our business, such as IT and administration and hosting, marketing agencies, vendors, service providers, contractors, and agents in connection with the performance of services on our behalf. These service providers are prohibited from using your information except as needed to perform our work or as required by law;
- Third parties approved by you, including social media sites you choose to link your account to or third-party payment providers;
- Social media platforms and networks such as Facebook, Twitter, TikTok, Pinterest, and Instagram that offer functionalities, plugins, widgets, or tools in connection with our products and services (e.g., to log into an account, or to share inspiration, finds, purchases, and other content with your friends and followers on social media). - Our insurers and brokers;
- Our banks;
- Third-parties for legal, protection, and safety purposes;
- Third-parties when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding;
- We may share Personal Information for any other purpose disclosed by us when you provide the Personal Information.
We may also sell, rent, or share aggregate consumer information (i.e., anonymized summary data) with others for their own uses. This aggregate consumer information will never include your name, phone number, email address, or mailing address. We may also need to share some Personal Information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.
7. Notice of Financial Incentives. We may offer financial incentives such as discounts, coupons, or promotional credits in exchange for your Personal Information (e.g., email address for signing up for marketing communications). These incentives are optional and participation is voluntary. You may withdraw from the incentive at any time by unsubscribing or contacting us at contact@thensome.com. We value your Personal Information consistent with the incentive provided, based on factors such as estimated revenue generated or marketing value.
8. Personal Information We Sold. As of the date of this Privacy Policy, in the preceding 12 months, we have not sold any Personal Information. However, we may sell the following categories of Personal Information in the future, as permitted by applicable law and in accordance with this Privacy Policy:

- Inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
9. How Long Your Personal Information Will Be Kept. We will keep your Personal Information while you have an account with us or while we are providing products or services to you. Thereafter, we will keep your Personal Information for as long as is necessary:
- To respond to any questions, complaints or claims made by you or on your behalf;
- To show that we treated you fairly; or
- To keep records required by law.
We will not retain your Personal Information for longer than necessary for the purposes set out in this Privacy Policy. Different retention periods apply for different types of Personal Information.
When it is no longer necessary to retain your Personal Information, we will delete or anonymize it.

You can request access to or deletion of your Personal Information, and where applicable, opt out of the sale of your Personal Information.
You may use an authorized agent to submit your privacy rights request. However, we are obligated to ensure that you have properly authorized the person acting as your agent to act on your behalf and we may require proof of written authorization.
Furthermore, we may require you to confirm your identity and your residency or location in order to honor your Privacy Rights request. If we are unable to verify your identity, we may not honor your Privacy Rights request. If we deny your request, we will notify you of the reason within thirty (30) days of receiving the request.

10.2 Opting Out of Marketing Communications. You can unsubscribe from our marketing communications at any time by clicking on the unsubscribe link provided in the emails.
10.3 Managing Cookes and Tracking Technologies. You can manage your preferences regarding cookies and tracking technologies through your browser settings. Note that altering these settings may affect the functionality of our website.

10.4 Communication Preferences. If you would like to change your contact information, please contact us using the information in the “How to Contact Us” section below. We will make a good faith effort to make requested changes in our active databases as soon as reasonably practicable. We may retain your prior contact information as part of our business records.
10.5 Do Not Track. Do Not Track is a web browser setting that requests that a web application disable its tracking of an individual user. When you choose to turn on the Do Not Track setting in your browser, your browser sends a signal to websites, analytics companies, ad networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity. Currently we do not respond or take any action with respect to these signals or similar mechanisms.
10.6 Opt-Out Preference Signals. Some browsers and browser extensions support opt-out preference signals such as the Global Privacy Control that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales. Global Privacy Control is a web browser-level setting, maintained by either a browser or a browser extension, that a user or privacy-focused technology can set. In certain regions, when we detect such a signal, we will make reasonable efforts to respect your choices as required by applicable law.

- Please note that you may only make a CCPA/CPRA-related data access or data portability disclosure request twice within a 12-month period.

- Enough information to identify you (e.g., your full name, address, and customer or matter reference number);
- Proof of your identity and address (e.g., a copy of your driving license or state issued identification and a recent utility or credit card bill); and
- A description of what right you want to exercise and the information to which your request relates.
- We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person's behalf.

12. Keeping Your Personal Information Secure. We have appropriate security measures in place to prevent Personal Information from being accidentally lost or used or accessed in an unauthorized way. We also have procedures in place to deal with any suspected data security breach. 14. Children's Privacy. Our website is designed for a general audience and not intended for children under 21 years old. We do not knowingly collect or process personal data from those under 21 years of age including minors. If you believe a child has provided Personal Information, please contact us for immediate removal.
15. California Residents. California Civil Code Section 1798.83, Californiaʼs “Shine the Light” law, permits users of our Site that are California residents and who provide Personal Information in obtaining products and services for personal, family, or household use to request certain information regarding our disclosure of Personal Information to third parties for their own direct marketing purposes. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we shared your Personal Information with for the immediately prior calendar year.
